The most obvious (and the only one I'll point out) is that it argues from semantics. Marriage might be a religious concept (that's highly debatable), but in our society it is 100% secular. There is no religious requirement whatsoever for anyone to obtain a marriage license and enter into that specific contract. If a couple wants to marry in a church or temple or a pentagram within a circle, they can do so but unless they obtain that secular license from the state it is merely ceremony. When your friend asserts that the state should sanction "civil unions" and not "marriage" he is playing a word game and he is purposely ignoring that marriage in the eyes of the state is secular.
